Two sets of terms live on this page: terms for the builder/business that administers a subscription, and terms for a homeowner using the client portal through their builder.

Part 1 — Business customer terms

Applies to the construction company or builder that administers a Hearthline subscription.

  • Definitions (Company, Customer, Authorized Users, End Users, Content, Services)
  • Account & subscription (organization accounts, admin roles)
  • Fees, billing & renewal (pricing, auto-renew, taxes, late payment, price changes)
  • License grant & restrictions (no reselling, no reverse engineering)
  • Customer data & ownership — the Customer owns its project/selections data; Hearthline holds a limited license to host and process it; data export rights on termination
  • Term, suspension & termination, including data retention/deletion after termination
  • Service availability (uptime target, maintenance windows)
  • Support
  • Warranties & disclaimers (“as is”; no warranty that AI output is accurate)
  • Limitation of liability (cap at fees paid; excludes indirect/consequential damages)
  • Indemnification (mutual — Hearthline for IP claims, Customer for misuse or uploaded content)
  • Confidentiality
  • Governing law & dispute resolution
  • Changes to these terms; assignment; force majeure; entire agreement

Part 2 — Homeowner (end user) terms of use

Applies to a homeowner using the client portal, invited by their builder.

  • Acceptance & eligibility — you're invited by your builder; there's no self-signup
  • Account & access (passwordless, magic-link sign-in)
  • Relationship to your builder — the portal is provided to you through your builder; Hearthline is a service provider, not a party to your construction contract
  • Permitted use / prohibited conduct
  • Content you submit (maintenance-log photos, PDFs, chat messages) — a license for Hearthline to store and display it, with no transfer of ownership
  • Disclaimers & limitation of liability
  • Termination of access
  • Governing law

AI assistant disclaimer

  • AI-generated responses — maintenance recommendations, chat troubleshooting, and data extracted from uploaded documents — may be inaccurate or incomplete.
  • This is not professional, licensed, or safety advice. Always consult a qualified, licensed professional for electrical, gas, structural, or other safety-related issues.
  • Not for emergencies. Call 911 or the appropriate emergency service instead of the assistant.
  • Hearthline is not liable for actions taken based on AI-generated output.

Acceptable use

Prohibited: illegal content, harassment, malware, scraping or automated access, reselling or sublicensing access, attempting to bypass security, abusive use of AI features (e.g. prompt injection), and impersonation.
